INTRODUCTION

THIS SUBSCRIPTION AGREEMENT ("AGREEMENT") IS A LEGAL AND BINDING AGREEMENT BETWEEN YOU, AS THE MEMBER, AND PRO.ELECTROBUZZ.NET ("ELECTROBUZZ"). PLEASE READ THIS AGREEMENT CAREFULLY PRIOR TO USING THE ELECTROBUZZ SUBSCRIPTION SERVICE.

BY REGISTERING FOR THE SERVICE, YOU ARE CONSENTING TO BECOME A PARTY TO THIS AGREEMENT AND AGREEING TO BE BOUND BY THE TERMS AND CONDITIONS HEREIN. IF YOU DO NOT ACCEPT AND AGREE TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT CONTINUE THE REGISTRATION PROCESS.

1. ENROLLMENT IN THE SERVICE

Electrobuzz provides an Internet‑based music service for sampling and downloading promotional music in common portable formats (i.e. MP3). The service consists of subscription or download‑credit plans whereby, for a periodic fee and subject to certain limitations described herein, you are granted limited download rights to our catalogue of promotional music files.

Requirements:

  • Internet access (fees are your responsibility)

  • Appropriate equipment to download/listen to the files

  • Minimum age 18 years to enrol

To begin enrolment, complete the registration form at https://pro.electrobuzz.net ("Electrobuzz Website").

2. MODIFICATION

We may modify any term of this Agreement at any time in our sole discretion.

  • Notice will be provided by e‑mail where reasonably possible and via a change notice posted at https://pro.electrobuzz.net.

  • If any modification is unacceptable to you, your only recourse is to terminate this Agreement (see Section 7).

  • Continued use of the service after a change notice constitutes your binding acceptance of the modification.

Licensor caveat: If Electrobuzz’s licence from a third‑party music rights‑holder terminates, you may be required to delete affected files. We’ll notify you of any such tracks.

3. YOUR REGISTRATION OBLIGATIONS

You agree to provide true, accurate, current and complete information (“Registration Data”) during sign‑up. After subscribing, you will receive a password and account.

  • Confidentiality: You are solely responsible for maintaining your password.

  • Account activity: You are responsible for all activities under your account.

  • Security breaches: Notify us immediately of any unauthorised use.

  • Privacy: Complete privacy of data transmitted on the service cannot be guaranteed.

4. ELECTROBUZZ PRIVACY POLICY

Per our Privacy Policy, Electrobuzz may release aggregate Registration Data (e.g., sales by postal code) but will not release individual sales info unless required by law.

5. TECHNOLOGICAL AND USE LIMITATIONS

5.1 Service availability

Electrobuzz will make reasonable efforts to keep the Website operational. However, technical difficulties or routine maintenance may result in temporary interruptions. We may modify or discontinue functions of the service at any time without notice. Electrobuzz is not liable for consequences of such interruptions.

5.2 Automated downloads prohibited

Use of any automated system to select or download files is not allowed. Violation may result in immediate, permanent termination of access.

6. TERM, FEES AND PAYMENTS

6.1 Subscription fees

By registering, you agree to pay the applicable periodic rate in advance. Rates may change; changes take effect only after the current paid period expires.

6.2 Recurring billing

Fees are charged to the credit card (or PayPal) you designated. Unless cancelled before the current period ends, your subscription auto‑renews for an equal duration. All fees are non‑refundable.

6.3 Collection costs

You agree to pay Electrobuzz reasonable attorney’s fees and costs to collect past‑due amounts. Accounts may be deactivated without notice if payment is past due.

6.4 Taxes

You are responsible for any government taxes imposed on your use of the service.

6.5 Fee changes

Electrobuzz reserves the right to change fees, billing methods, or add supplemental charges at any time. Notice provided via e‑mail or online posting. Continued use after the effective date = acceptance.

7. TERMINATION

7.1 By Electrobuzz

We may terminate your account or access at any time for any reason, including violation of this Agreement. We may discontinue the service altogether with or without notice.

7.2 By you

You may terminate at any time with 72 hours notice via the Cancel Account function. No refunds for unused days in the current billing cycle; payments in advance are non‑refundable.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Usage restrictions

Content may be downloaded strictly for promotional use as a professional DJ. You may not reproduce, distribute, sell, or circulate the content for other purposes without written consent. You agree to indemnify Electrobuzz for violations.

8.2 Ownership

Electrobuzz retains exclusive ownership of the service and all associated IP rights. You are granted no licence beyond what is expressly stated. Notify Electrobuzz of any unauthorised use or infringement.

9. FAIR USE NOTICE AND CONTENT DISCLAIMER

Electrobuzz is a promotional music distribution service—not for building personal music catalogues. Consecutive days with download counts beyond reasonable promotional use may result in suspension.

Material is distributed in accordance with Title 17 U.S.C. § 107 (fair use). If you need to use copyrighted material beyond fair use, obtain permission from the copyright owners.

10. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. The service is provided “AS IS” and “AS AVAILABLE.” Electrobuzz disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non‑infringement, and accuracy.

11. LIMITATION OF LIABILITY

Electrobuzz will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this Agreement or the service, even if advised of the possibility.

Our aggregate liability will not exceed the total fees you have paid under this Agreement.
